Terms of Service
1. Introduction
Welcome to CHAAMO. These Terms of Service (“Terms”) govern your access to and use of our platform, including our website, mobile application, and any associated services (collectively, the “App”). By using CHAAMO, you agree to comply with and be bound by these Terms.
Our goal is to keep this Agreement as clear and straightforward as possible while ensuring full legal compliance. These Terms outline important information about your rights, responsibilities, and obligations when using our services. They also explain our policies regarding payments, refunds, disputes, and other key aspects of the CHAAMO platform.
If you do not agree to these Terms, you must not use CHAAMO.
Definitions and Interpretation
In these Terms of Service, unless the context otherwise requires:
“Platform” means the CHAAMO website, mobile application, and related services operated by CHAAMO LTD.
“User” means any individual who accesses or uses the Platform, including buyers and sellers.
“Buyer” means a User who purchases an item through the Platform.
“Seller” means a User who lists or sells an item through the Platform.
“Transaction” means a completed purchase between a buyer and a seller facilitated via the Platform.
“Held Funds” means transaction funds temporarily held pending order confirmation, refund resolution, or dispute outcome.
2. Your Acceptance of this Agreement
These Terms of Service are entered into by and between You and CHAAMO LTD, d/b/a CHAAMO (“Company,” “we,” “our,” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively “Terms of Service”), govern your access to and use of the CHAAMO app, including any content, functionality, and services offered on or through the CHAAMO app (the “App”), whether as a guest or a registered user. We offer the following service that is subject to these Terms of Service: Pre-sale memberships (collectively “Services”).
Please read the Terms of Service carefully before you start to use the App.
By using the App [or by clicking to accept or agree to the Terms of Service when this option is made available to you], you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms of Service, you must not access or use the App.
You must be at least 18 years old to use this App. CHAAMO does not permit or approve the use of its services by individuals under the age of 18.
By accessing or using the App, you confirm that you are at least 18 years old. If it is determined that a user is under 18, CHAAMO reserves the right to immediately suspend or terminate the account without prior notice.
CHAAMO accepts no responsibility or liability for any unauthorised use of the App by individuals under 18.
BY ACCESSING AND USING THIS APP, YOU:
- ACCEPT AND AGREE TO BE BOUND AND COMPLY WITH THESE TERMS OF SERVICE;
- REPRESENT AND WARRANT THAT YOU ARE THE LEGAL AGE OF MAJORITY UNDER APPLICABLE LAW TO FORM A BINDING CONTRACT WITH US; AND,
- AGREE THAT IF YOU ACCESS THE APP FROM A JURISDICTION WHERE IT IS NOT PERMITTED, YOU DO SO AT YOUR OWN RISK.
3. Updates to Terms of Service
We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the App thereafter.
Continuing to use the App or making subsequent purchases following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page each time you access this App so you are aware of any changes, as they are binding on you.
4. Your Responsibilities
You are required to ensure that all persons who access the App are aware of this Agreement and comply with it. The App, including content or areas of the App, may require user registration. It is a condition of your use of the App that all the information you provide on the App is correct, current, and complete.
Any username, password, or any other piece of information chosen by you or provided to you as part of our security procedures must be treated as confidential, and you must not disclose it to any other person or entity. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. You also agree to ensure that you log out from your account at the end of each session. You are responsible for any password misuse or any unauthorized access.
YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR YOUR USE OF THE APP AND YOUR DEVICE, INTERNET, AND DATA SECURITY.
Electronic Communications
By creating an account or using the Platform, you consent to receive electronic communications from CHAAMO, including notices, disclosures, policy updates, transactional emails, and support messages via email, in-app notifications, or other electronic means. You also agree to receive marketing and promotional emails from CHAAMO about platform features, offers, and services. You may opt out of these marketing emails at any time by clicking the unsubscribe link provided in such communications.
You agree that such electronic communications satisfy any legal requirement that communications be in writing.
5. Prohibited Activities
You may use the App only for lawful purposes and in accordance with these Terms of Service. You agree not to use the App:
- In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the exports of data software to and from the U.S. or other countries).
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.
- To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Submission Standards set out in these Terms of Service.
- To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other persona or entity (including, without limitation, by using email addresses associated with any of the foregoing).
- To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App or which, as determined by us, may harm the Company or users of the App, or expose them to liability.
Additionally, you agree not to:
- Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party’s use of the App, including their ability to engage in real-time activities through the App.
- Use any robot, spider, or other automatic device, process, or means to access the App for any purpose, including monitoring or copying any of the material on the App.
- Use any manual process to monitor or copy any of the material on the App, or for any other purpose not expressly authorized in these Terms of Service, without our prior written consent.
- Use any device, software, or routine that interferes with the proper working of the App.
- Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
- Attack the App via a denial-of-service attack or a distributed denial-of-service attack.
- Otherwise attempt to interfere with the proper working of the App.
6. Intellectual Property Rights
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
These Terms of Service permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows:
- Your device may temporarily store copies of such material in RAM incidental to your accessing and viewing those materials.
- You may store files that are automatically cached by your Web browser for display enhancement purposes.
- You may print or download one copy of a reasonable number of pages of the App for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
- If we provide desktop, mobile, or other applications for download, you may download a single copy to your device solely for your own personal, non-commercial use, provided you agree to be bound by our End User License Agreement for such applications.
You must not:
- Modify copies of any materials from this App.
- Delete or alter any of the copyright, trademark, or other proprietary rights notices from copies of materials from this App.
You must not access or use for any commercial purposes any part of the App or any services or materials available through the App.
If you print, copy, modify, download, or otherwise use or provide any other person with access to any part of the App in breach of the Terms of Service, your right to use the App will stop immediately, and you must, at our option, return or destroy any copies of the materials you have made. No right, title, or interest in or to the App or any content on the App is transferred to you, and all rights not expressly granted are reserved by the Company. Any use of the App not expressly permitted by these Terms of Service is a breach of these Terms of Service and may violate copyright, trademark, and other laws.
7. User Submissions and Submission Standards
The App may provide you with the opportunity to create, submit, post, display, transmit, publicise, distribute, or broadcast content and materials to us or in the App, including but not limited to text, writings, video, audio, photographs, graphics, comments, ratings, reviews, feedback, personal information, or other material (collectively, “Content”). You are responsible for your use of the App and for any content you provide, including compliance with applicable laws, rules, and regulations.
All User Submissions must comply with the Submission Standards and Prohibited Activities set out in these Terms of Service.
Any User Submissions you post to the App will be considered non-confidential and non-proprietary. By submitting, posting, or displaying content on or through the App, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, disclose, adapt, modify, publish, transmit, display, and distribute such Content for any purpose, commercial advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Content, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media format and through any media channels.
You represent and warrant that:
- You own or control all rights in and to the User Submissions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns.
- All of your User Submissions comply with these Terms of Service.
We do not assert any ownership over your Content. You retain full ownership of all of your Content and any intellectual property rights or other proprietary rights associated with your Content. We are not liable for any statement or representation in your Content provided by you in any area in the App. You are solely responsible for your Content related to the App, and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Content.
We are not responsible or liable to any third party for the content or accuracy of any User Submissions posted by you or any other user of the App. User Submissions are not endorsed by us and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any User Submission or for any claims, liabilities, or losses resulting from any review.
We have the right, in our sole and absolute discretion, to:
- Edit, redact, or otherwise change any Content.
- Recategorize any Content to place it in more appropriate locations in the App.
- Pre-screen or delete any Content at any time and for any reason, without notice.
We have no obligation to monitor your Content. Any use of the App in violation of these Terms of Service may result in, among other things, termination or suspension of your right to use the App.
These Submission Standards apply to any and all User Submissions. User Submissions must, in their entirety, comply with all the applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Submissions must not:
- Contain any material that is defamatory, obscene, indecent, abusive, offensive, misleading, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
- Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
- Violate the legal rights of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may conflict with these Terms of Service and our Privacy Policy.
- Be likely to deceive any person.
- Promote any illegal activity, or advocate, promote, or assist in any unlawful act.
- Cause annoyance, inconvenience, or needless anxiety, or be likely to upset, embarrass, alarm, or annoy any other person.
- Impersonate any person or misrepresent your identity or affiliation with any person or organization.
- Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising.
- Give the impression that they emanate from or are endorsed by us or any other person or entity if this is not the case.
8. Our Rights
We have the right, without provision of notice, to:
- Remove or refuse to post any User Submission for any or no reason in our sole discretion.
- Take any action with respect to any User Submission that we deem necessary or appropriate in our sole discretion, including if we believe that such User Submission violates the Terms of Service, including the Submission Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the App or the public, or could create liability for the Company.
- Take appropriate legal action, including, without limitation, referral to or cooperation with law enforcement or regulatory authorities or notifying the harmed party of any illegal or unauthorized use of the App.
- Terminate or suspend your access to all or part of the App for any or no reason, including, without limitation, any violation of these Terms of Service.
9. Third-Party Links and Content
For your convenience, this App may provide links or pointers to third-party sites or third-party content. We make no representations about any other apps, websites, or third-party content that may be accessed from this App. If you choose to access any such sites or content, you do so at your own risk. We have no control over the third-party content or any such third-party sites and accept no responsibility for such sites or for any loss or damage that may arise from your use of them. You are subject to any terms and conditions of such third-party sites.
10. Software
By downloading our software, you acknowledge and agree to our End User License Agreement (“EULA”). The terms of the EULA will govern your use of the software.
11. Mobile Application
By using our mobile application, you acknowledge and agree to our EULA as well as the following:
If the mobile application fails to conform to any applicable warranty, you may notify the applicable application distributor, and the application distributor may refund any applicable purchase price in accordance with its terms and policies. To the maximum extent permitted by applicable law, the application distributor will have no other warranty obligation with respect to the mobile application.
You represent and warrant that:
You are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist-supporting” country.
You are not listed on any U.S. government list of prohibited or restricted parties.
Our mobile application is currently available in select regions. Availability may change due to legal, technical, or commercial reasons.
You must comply with applicable third-party terms of service when using the mobile application.
You acknowledge and agree that the application distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these Terms of Service and that each application distributor will have the right to enforce the terms and conditions in this mobile application license contained in these Terms of Service against you as a third-party beneficiary thereof.
12. Online Orders
For physical goods (e.g., trading cards), references to “sell”, “sale”, “purchase”, and similar terms refer to a sale of goods between users. For digital content or app access, those terms may refer to a licence.
- Where an order indicates a license is being purchased:
- All uses on this app of the terms “sell”, “sale”, “resell”, “resale”, “purchase”, “price”, and the like mean the purchase or sale of a license.
- You will comply with all terms and conditions of the applicable license Terms of Service for any goods, digital products, or information you obtain through this app, and you will not cause, induce, or permit others’ non-compliance with the terms and conditions of any license Terms of Service for the goods, digital products, or information.
- Except for the limited license granted under the relevant license Terms of Service, nothing in these Terms of Service grants any right, title, or interest in or to (including any license under) any intellectual property rights in or relating to the goods, digital products, or information, whether expressly, by implication, estoppel, or otherwise. All rights, title, and interest in and to the goods, digital products, or information are and will remain with the Company or its licensors, as applicable.
13. Payment and Fees
All payments on the CHAAMO platform are processed through PayPal. As such, CHAAMO only accepts payment methods that are supported by PayPal. The availability of payment methods is subject to PayPal’s policies and may vary by region. CHAAMO does not control which payment methods are accepted and reserves the right to update or modify payment processing terms in accordance with PayPal’s policies.
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the app and to promptly update account and payment information, including email address, payment method, and payment card expiration date, in order to complete your purchases and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in GBP.
You agree to pay all charges or fees at the prices then in effect for your purchases, and you authorise us to charge your chosen payment provider for any such amounts upon making your purchase.
If your purchase is subject to recurring charges, you must keep a valid payment method on file with the Company to pay for all incurred and recurring fees. The Company will charge applicable fees to any valid payment method that you have provided, and you will be invoiced automatically as outlined in the order. You authorise such payment of recurring fees without requiring your prior approval for each recurring charge until you notify us of your cancellation, or the Company terminates in writing in accordance with these Terms of Service, or until the recurring contract ends, and any and all outstanding fees and charges have been paid in full.
We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment. We also reserve the right to refuse any order placed through the app.
From time to time, the Company may offer a limited free trial and/or promotional codes for a specified period, which may be subject to additional terms. We have sole discretion to determine your eligibility for trials and/or promotional codes. If you are required to provide payment information in connection with your trial, your first payment will be charged to your chosen payment method following the expiration of the trial unless earlier terminated in accordance with these Terms of Service. You may not receive a separate notice that your free trial is about to end or has ended, or that your paid subscription has begun.
14. Cancellation
Monthly subscriptions to CHAAMO are processed through third-party platforms, specifically the Apple App Store and Google Play Store. As such, all subscription cancellations must be managed directly through the relevant app store. You can cancel your subscription at any time by accessing your Apple or Google account settings and managing your CHAAMO subscription there.
CHAAMO does not have the ability to cancel subscriptions on your behalf, nor can it process refunds for subscriptions purchased through these app stores. All refund requests must be submitted to Apple or Google in accordance with their respective policies.
Subscription purchases are non-refundable, hold no monetary value (i.e., they are not cash or cash equivalents), and provide only a non-exclusive, revocable, non-assignable, and non-transferable right to access the subscription features.
You may not transfer, sell, purchase, barter, or trade your subscriptions, nor attempt or offer to do so. Any such action will be considered null and void.
Except as required by applicable law, CHAAMO is not responsible for any refunds or credits related to modified, suspended, or terminated subscriptions.

Survival
Any provisions of these Terms which by their nature should survive termination shall survive, including but not limited to provisions relating to refunds, dispute resolution, limitation of liability, indemnification, intellectual property, governing law, and jurisdiction.
15. Disclaimers, Liability, and Indemnification
YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE APP, ITS CONTENT, AND ANY GOODS, DIGITAL PRODUCTS, SERVICES, INFORMATION, OR ITEMS FOUND OR ATTAINED THROUGH THE APP IS AT YOUR OWN RISK. THE APP, ITS CONTENT, AND ANY GOODS, SERVICES, DIGITAL PRODUCTS, INFORMATION, OR ITEMS FOUND OR ATTAINED THROUGH THE APP ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
YOU ACKNOWLEDGE AND AGREE THAT THE COMPANY OR ITS RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, OR SUCCESSORS MAKE NO WARRANTY, REPRESENTATION, OR ENDORSEMENT WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, SUITABILITY, ACCURACY, CURRENCY, OR AVAILABILITY OF THE APP OR ITS CONTENTS OR THAT ANY GOODS, SERVICES, DIGITAL PRODUCTS, INFORMATION, OR ITEMS FOUND OR ATTAINED THROUGH THE APP WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR APP OR THE SERVER THAT MAKES IT AVAILABLE OR CONTENT ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR DESTRUCTIVE CODE.
16. Privacy Policy
Your provision of personal information through the app is governed by our privacy policy located at /privacy-policy (the “Privacy Policy”).
16.1 Cookie Notice
Our website and mobile app use cookies and similar tracking technologies to enhance performance, enable core features, and analyse usage. Details are provided in our cookie banner and preferences tool. By continuing to use our services, you consent to our use of cookies unless you change your browser or device settings.
17. Governing Law
The app and these Terms of Service will be governed by and construed in accordance with the laws of the United Kingdom and any applicable federal laws applicable therein, without giving effect to any choice or conflict of law provision, principle, or rule and notwithstanding your domicile, residence, or physical location.
Any action or proceeding arising out of or relating to this app and/or under these Terms of Service will be instituted in the courts of the United Kingdom, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.
If you are a citizen of any European Union country or Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
The parties agree that the United Nations Convention on Contracts for the International Sale of Goods will not govern these Terms of Service or the rights and obligations of the parties under these Terms of Service.
18. Severability
If any provision of these Terms of Service is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms of Service will continue in full force and effect.
19. Entire Terms of Service
These Terms of Service constitute the entire and only Terms of Service between the parties in relation to its subject matter and replace and extinguish all prior or simultaneous Terms of Services, undertakings, arrangements, understandings, or statements of any nature made by the parties or any of them whether oral or written (and, if written, whether or not in draft form) with respect to such subject matter.
Each of the parties acknowledges that they are not relying on any statements, warranties, or representations given or made by any of them in relation to the subject matter of these Terms of Service, save those expressly set out in these Terms of Service, and that they shall have no rights or remedies with respect to such subject matter otherwise than under these Terms of Service save to the extent that they arise out of the fraud or fraudulent misrepresentation of another party.
No variation of these Terms of Service shall be effective unless it is in writing and signed by or on behalf of the Company.
20. Waiver
No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or power hereunder preclude further exercise of that or any other right hereunder.
21. Notice
We may provide any notice to you under these Terms of Service by:
- Sending a message to the email address you provide to us and consent to us using; or
- Posting to the app.
Notices sent by email will be effective when we send the email, and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
To give us notice under these Terms of Service, you must contact us as follows:
- By personal delivery, overnight courier, or registered or certified mail to CHAAMO LTD, 287A Fleet Road, Hampshire, GU51 3BZ, England, GB.
We may update the address for notices to us by posting a notice on this app. Notices provided by personal delivery will be effective immediately once personally received by an authorised representative of the Company. Notices provided by overnight courier or registered or certified mail will be effective once received, and where confirmation has been provided to evidence the receipt of the notice.
22. Order Fulfilment Obligation
By participating in auctions or utilising the “Buy It Now” feature, users agree to complete the transaction upon winning an auction or confirming a purchase. Failure to fulfil these obligations without valid cause constitutes a breach of CHAAMO’s Terms and Conditions.
CHAAMO reserves the right to take corrective action, up to and including permanent suspension of the user’s account, for any unfulfilled orders. Users who fail to fulfil their orders on three separate occasions will be permanently banned from accessing CHAAMO’s services.
23. Refund Policy
CHAAMO operates as a consumer-to-consumer marketplace. Contracts of sale are formed directly between the buyer and the seller. Refunds are facilitated by CHAAMO LTD in accordance with the Refund & Returns Policy, Buyer Protection Policy, and these Terms of Service.
23.1 Refund Request Timeline
Once an item is marked as delivered by the courier, the buyer has forty-eight (48) hours to either confirm receipt or submit a refund request. Refund requests submitted after this forty-eight (48) hour period will not be eligible for consideration except as required by applicable law.
23.2 Funds on Hold During Review
If a refund request is submitted within the required timeframe, the transaction funds will be placed on hold and will not be released to the seller until the refund issue has been resolved. Funds will only be released once the buyer confirms the order or a final determination has been made under this policy.
23.3 Refund Process
Refunds require mutual agreement between the buyer and the seller. Where a refund is mutually agreed, the seller authorises CHAAMO LTD to release the held transaction funds to the buyer via the original payment method. Refunds are strictly limited to the amount held for the relevant transaction.
If the buyer and seller are unable to reach an agreement, or either party rejects the proposed refund, CHAAMO LTD is unable to process the refund directly. In such cases, the buyer must escalate the matter through the third-party payment processor (e.g., PayPal) dispute resolution process in accordance with their Buyer Protection policies. The transaction funds will remain on hold pending the outcome of that process.
CHAAMO does not act as the merchant of record, payment processor, or escrow agent and does not guarantee any refund outcome.
23.4 CHAAMO’s Role
CHAAMO does not act as the merchant of record and does not assume liability for the condition of items sold. However, CHAAMO may review evidence, facilitate communication, and determine whether a refund is warranted under the Terms of Service, Buyer Protection Policy, and applicable platform rules.
23.5 Seller Obligations
Sellers are required to respond promptly to refund requests. Failure to respond, cooperate, or comply with finalised refunds may result in enforcement action, including payout holds, account restrictions, suspension, or permanent removal from the platform.
23.6 Exclusions
Refunds are not available for change-of-mind purchases unless explicitly stated in the listing. Requests submitted outside applicable timeframes may be declined.
24. Funds Disbursement Policy
Transaction funds will only be released to the seller after all of the following:
The item is confirmed as delivered by the courier; and
Either:
a. The buyer manually confirms receipt through the CHAAMO platform; or
b. Forty-eight (48) hours have passed since delivery with no refund request submitted.
If a refund request is submitted within the forty-eight (48) hour review period, the funds will remain on hold and not disbursed until the refund is resolved in accordance with Section 23 and the Refund & Returns Policy.
If the buyer escalates a dispute to the third-party payment processor (e.g., PayPal), the funds will remain on hold until the processor’s final decision.
If no refund is agreed, and the dispute is not escalated, the held funds will be released to the seller once the review period expires.
Sellers must respond to refund requests and comply with dispute resolution processes. Failure to do so may result in enforcement action, including payout holds, account suspension, or permanent removal.
UK Consumer Rights Disclaimer
CHAAMO operates as a consumer-to-consumer (C2C) platform. Transactions between users are generally not covered by statutory business-to-consumer (B2C) consumer rights such as the Consumer Rights Act 2015. Buyers and sellers are expected to act in good faith and resolve disputes in accordance with CHAAMO’s refund, dispute, and platform policies.
25. Damaged Goods Policy
The seller is responsible for ensuring that items are packaged adequately to prevent damage during transit. If packaging is insufficient and damage occurs, the seller remains liable for any resulting refund, subject to applicable platform policies.
If damage is caused by factors beyond the seller’s control, CHAAMO may assist in reviewing evidence and coordinating with carriers or insurance providers where applicable. Any compensation or liability from carriers is governed by the carrier’s policies.
Refunds related to damage are subject to the refund and dispute resolution procedures in Sections 23 and 24.
26. Age Restriction Policy
CHAAMO is strictly intended for individuals 18 years of age or older. By accessing or using the CHAAMO platform, you confirm that you are at least 18 years old.
CHAAMO does not approve, permit, or promote the use of its services by individuals under the age of 18. If it is discovered that a user is under 18, CHAAMO reserves the right to immediately suspend or terminate the account without prior notice.
CHAAMO accepts no responsibility or liability for any unauthorised use of the platform by individuals under 18. It is the responsibility of parents and legal guardians to ensure that minors do not access or use CHAAMO’s services
27. Postage Policy
The buyer is responsible for postage costs as part of the transaction unless otherwise agreed between the buyer and seller.
Where a return is authorised due to damage or material misrepresentation, the seller is responsible for covering return shipping costs. If the seller and buyer agree to a return for any other reason, the parties must determine who bears return postage, and any such terms must be clearly disclosed in the listing.
Any postage liability is subject to the Refund & Returns Policy and the dispute resolution timelines in Sections 23 and 24.
28. Abusing CHAAMO Policy
Without limiting other remedies, CHAAMO reserves the right to limit, suspend, or terminate your user account(s) and access to our Services; restrict or prohibit your activities on our platform; cancel bids; remove, demote, or otherwise restrict the visibility of listings; delay or remove hosted content; revoke any special account statuses; reduce or eliminate discounts or promotional benefits; and take technical or legal measures to prevent your access to our Services if:
- We believe you are creating problems or potential legal liabilities for CHAAMO, its users, suppliers, or other third parties;
- We believe such restrictions will improve the security of the CHAAMO community or reduce our or another CHAAMO user’s exposure to financial liabilities;
- We believe you are infringing upon the rights of third parties;
- We believe you are acting inconsistently with the letter or spirit of this User Agreement or our policies, or are abusing our employees or other users;
- Despite reasonable efforts, we are unable to verify or authenticate the information you provide to us; or
- You fail to make, or it is evident that you are unable to make, full payment of any fees or charges due for our Services by the specified payment deadline.
CHAAMO may provide a process for users to report claimed violations, which we will review and address at our sole discretion.
When resolving disputes between buyers and sellers, CHAAMO may take into account the user’s performance history, as well as the specific circumstances of the issue, in determining appropriate action. At its sole discretion, CHAAMO may choose to be more lenient with policy enforcement when doing so is deemed fair or appropriate for both parties involved.
29. Fees and Payment Policy
CHAAMO operates with a transparent fee structure to ensure users have full clarity over any costs associated with using our platform.
- Standard Listings and Commission
CHAAMO does not charge fees for creating standard listings on the platform, nor does CHAAMO collect any commission on items sold through the platform. Sellers retain the full proceeds of their sales, except where third-party transaction fees (e.g., payment processing fees) may apply, as determined by the payment provider. - Featured Listings
CHAAMO offers users the option to enhance the visibility of their listings through the “Boost” feature. Fees for boosting or featuring a listing are clearly disclosed at the time the user selects to boost a listing. By choosing to boost a listing, the user agrees to the associated fee. These fees are non-refundable once the service has been activated, except in cases of system errors attributable to CHAAMO. - Monthly Subscription Fee
Access to CHAAMO’s services is subject to a monthly subscription fee. This fee is disclosed at the time of registration or subscription initiation and is billed on a recurring basis, in accordance with the payment terms specified at the time of sign-up. Subscription fees are non-refundable unless otherwise stated or required by applicable law. Users are responsible for ensuring that payment methods are valid and up to date to avoid disruption of service. - Checkout and Buyer Protection Fees
A base operating fee of £0.30 per transaction, plus a variable transaction processing component (e.g., 2.9% for UK transactions and 4.9% for international transactions) to support secure payments, transaction processing, fraud prevention, and platform infrastructure.
Buyer Protection Fee:
- Members: Buyer Protection is included as part of the membership.
- Non-members: A £1.00 Buyer Protection Fee per transaction.
Transaction fees and Buyer Protection Fees are charged by CHAAMO as part of the services it supplies and may reflect payment and operational costs. These fees are inclusive of VAT where applicable and form part of CHAAMO’s service charges.
VAT:
Where required by law, VAT applies to CHAAMO service fees (such as platform transaction fees, operating fees, Buyer Protection fees, and Boost/Featured Listing fees) and is included in the prices displayed to users. VAT does not apply to the value of goods sold between users in peer-to-peer transactions.For EU consumers where VAT applies under the One Stop Shop (OSS) scheme, the applicable VAT will be included in the price and charged at the rate of the user’s EU Member State.
- Failure to Pay Fees
Failure to pay any applicable fees when due may result in limitations on account functionality, suspension, or termination of access to CHAAMO’s services. CHAAMO reserves the right to take further action, including but not limited to referring unpaid accounts to collection agencies or pursuing legal remedies, where necessary. - Amendments to Fees
CHAAMO reserves the right to modify its fee structure, including introducing new fees or adjusting existing ones, at its sole discretion. Users will be notified of any changes to the fee structure via email or through the platform, with at least thirty (30) days’ notice prior to the changes taking effect. Continued use of CHAAMO’s services after the notification period constitutes acceptance of the updated fee structure. - Disputes Regarding Fees
In the event of a dispute regarding any fees charged by CHAAMO, users are required to notify CHAAMO at support@chaamo.com within thirty (30) days of the fee being charged. CHAAMO will investigate the matter and, if an error is found, will issue a refund or credit to the user’s account as appropriate. CHAAMO’s decision regarding fee disputes shall be final and binding.
By using CHAAMO’s platform and services, users acknowledge and agree to this Fees and Payment Policy, including their obligation to pay all applicable fees in accordance with this policy.
30. Listing Conditions
As a user of the CHAAMO platform, you are solely responsible for the accuracy, completeness, content, and legality of any item you list, including all associated listing content. This includes but is not limited to content created or modified using tools offered by CHAAMO or third parties, such as translation services, image editing tools, and generative artificial intelligence tools.
By creating a listing on CHAAMO, you agree to ensure that your item and listing content comply fully with CHAAMO’s Prohibited and Restricted Items Policy and all other applicable policies and guidelines.
It is your responsibility to:
- Provide accurate and truthful descriptions of the items you list, including but not limited to item condition, functionality, and any applicable disclosures (e.g., defects, damage, or modifications).
- Ensure that your listing complies with all relevant laws and regulations, including those related to the sale of restricted or regulated items in your jurisdiction and the jurisdiction of your potential buyers.
- Refrain from using misleading or deceptive practices in your listing, including false advertising, counterfeit goods, or unauthorized use of intellectual property.
CHAAMO does not assume responsibility for the content of your listings or any liabilities arising from non-compliance with this policy.
31. Prohibited and Restricted Items Policy
CHAAMO is a marketplace dedicated exclusively to the buying, selling, and trading of authentic Trading Cards. To ensure platform integrity, user safety, and compliance with legal and industry standards, the listing, sale, or distribution of any items that fall outside this scope is strictly prohibited.
31.1 Permitted Items
Only authentic trading cards from recognised trading card games or collectible series (e.g., Pokémon, Magic: The Gathering, sports cards, entertainment cards, etc.) may be listed on CHAAMO. Cards may be listed in any condition, provided the condition is accurately described. Graded cards may be listed only where grading information is accurate and verifiable.
31.2 Prohibited Items
The following items are strictly prohibited on the platform:
A. Non–Trading Card Items
Items that are not trading cards, including but not limited to: card sleeves, deck boxes, binders, storage cases, toploaders, protective materials, memorabilia or collectibles that are not trading cards, toys, figures, plush items, other merchandise, digital assets or NFTs, stickers, comics, or artwork. These categories, including card sleeves and toploaders, are reserved exclusively for approved partners and cannot be listed by general users.
B. Counterfeit, Misrepresented, or Altered Items
Fake, counterfeit, or reproduction cards; cards that have been tampered with (including recoloured, trimmed, pressed, rebacked, or otherwise altered); cards listed with misleading, incomplete, or deceptive descriptions; ungraded cards described as a specific grade (e.g., “PSA 10 quality”). Attempts to sell counterfeit or fraudulent items may result in permanent account termination and potential legal action.
C. Illegal or Rights-Infringing Items
Items that violate copyright, trademarks, or intellectual property rights; items that breach local, national, or international laws; stolen or fraudulently obtained cards; cards containing personally identifiable information (PII).
D. Hazardous or Restricted Items
Items posing safety or health risks; liquids, powders, or substances of any kind; promotional materials not intended for resale (including store signage or proprietary marketing materials).
31.3 Enforcement
CHAAMO may remove or refuse any listing that violates this policy, cancel transactions, restrict, suspend, or permanently terminate accounts, request proof of authenticity or ownership, or report illegal activity to relevant authorities. Severe or repeated violations may result in immediate permanent suspension without notice.
31.4 User Responsibility
Users must ensure all listed items comply with this policy and applicable laws, that all information provided is accurate and truthful, and that authenticity can be verified upon request. Users listing prohibited items accept full liability for any resulting disputes, losses, or legal consequences.
32. Purchase Conditions
By purchasing an item on CHAAMO, you agree to comply with the following conditions and acknowledge the responsibilities outlined below. You are responsible for reviewing the full item listing before placing a bid or committing to purchase, including all descriptions, images, and any seller-stated terms. Unless explicitly stated otherwise by CHAAMO, you enter into a legally binding contract with the seller when you: (a) commit to buy an item via the “Buy It Now” feature; or (b) win an auction by placing the highest bid, or your bid is otherwise accepted by the seller. All bids placed in an auction are binding contracts and cannot be withdrawn except where permitted by CHAAMO under exceptional circumstances. You agree to fulfil all payment obligations associated with your purchase in a timely manner as specified at checkout. Failure to complete payment may result in account suspension or removal from the platform. You acknowledge that CHAAMO is not the seller of the item and that the contract of sale is strictly between you and the seller.
33. Presale Membership Policy
By purchasing a presale membership for CHAAMO, you agree to the following terms and conditions regarding refunds and guarantees:
- Refund Eligibility
- Presale memberships are refundable only under the terms of a 14-day money-back guarantee, which becomes effective following the official launch of the CHAAMO app.
- Refund requests must be submitted within fourteen (14) calendar days from the launch date of the app. After this period, presale membership fees are non-refundable.
- Refund Request Process
- To request a refund, you must contact CHAAMO Customer Support at refunds@chaamo.com within the 14-day refund period.
- Refund requests must include proof of purchase and the email associated with your CHAAMO account.
- Refund Terms
- Refunds will only be issued to the original payment method used for the presale membership purchase.
- Refund processing may take up to ten (10) business days from the date of approval.
- Non-Refundable Fees
- After the 14-day refund period has elapsed, presale memberships are considered final, and no refunds will be issued for any reason, except as required by applicable law.
- Launch Date
- The launch date of the CHAAMO app will be announced by CHAAMO through official communication channels, including email and the CHAAMO website.
- Presale Membership Pricing
- The presale membership is offered at an introductory rate of £9.88 per month. This is a limited-time offer and will automatically increase to £12.99 per month after a three (3) month period.
- If you wish to cancel your membership, you must do so via the CHAAMO application prior to the price increase. Failure to cancel before the price adjustment will result in automatic billing at the updated rate of £12.99 per month.
- Acceptance of Terms
- By purchasing a presale membership, you acknowledge and agree to this Presale Membership Policy and waive any claims for refunds outside of the terms specified above.

34. Disclaimer for Card Uploads
By uploading a card for sale, trade, or showcase on the CHAAMO platform, you hereby confirm and agree to the following:
- Authenticity of the Card
- You confirm that the card you are uploading is an original and authentic item. You acknowledge that uploading counterfeit, fake, or misrepresented cards is strictly prohibited.
- Legal Accountability
- You understand and accept full responsibility for ensuring the card’s authenticity. Any attempts to upload fake or counterfeit cards may result in legal action against you, including but not limited to prosecution under applicable laws.
- Liability for Counterfeit Cards
- If it is determined that you have sold or traded a counterfeit card through the CHAAMO platform, you agree to assume full financial responsibility. This includes refunding all funds paid by the buyer and covering any additional damages or costs resulting from the fraudulent transaction.
- Refunds for Fraudulent Cards
- If a card sold through the CHAAMO platform is determined to be fraudulent, the original transaction will be refunded to the buyer. The refund will be processed through the same payment method used for the purchase. By listing or uploading a card on the platform, you expressly consent to this policy and authorize CHAAMO to initiate such refunds in cases involving fraudulent or misrepresented items.
- Platform Policy Enforcement
- You acknowledge that uploading counterfeit cards will result in immediate and permanent banning from the CHAAMO platform, without prior notice.
By proceeding with the upload, you confirm that the card complies with these terms. Failure to adhere to this disclaimer may result in severe consequences, including legal action.

35. Photographic Identification Policy
To maintain the safety, security, and integrity of the CHAAMO platform, we may request photographic identification from users at any time as part of our verification process. While ID verification is no longer required at the point of sign-up, CHAAMO reserves the right to request identification for fraud prevention, account verification, dispute resolution, or compliance with applicable policies.
- Verification Requests
- Users may be asked to submit valid photographic identification that matches the personal details on their CHAAMO account when prompted by our team.
- Non-Matching ID
If the ID provided does not match the user account details or appears to be false or altered, CHAAMO may suspend the account while further checks are completed.
Accounts may remain suspended until the ID has been successfully reviewed and verified.
- Data Privacy
CHAAMO does not share photographic ID or related verification data with any third parties.
This information is collected solely for identity verification purposes and for enforcing platform rules.
- User Responsibility
- Users are responsible for ensuring any submitted identification is accurate, valid, and up to date when requested.

35.1 Address and Phone Number Collection
To ensure secure and compliant marketplace operations, CHAAMO requires all users to provide a valid delivery address and phone number during the sign-up process. An account cannot be created without this information.
This data is collected for the following purposes:
To facilitate the shipment and delivery of goods between buyers and sellers;
To verify user identity and prevent fraud;
To ensure platform compliance with applicable marketplace, tax, and consumer protection regulations;
To enable order-related communication between the user, CHAAMO, and/or the courier.
CHAAMO only shares address and phone number details with relevant third parties (such as couriers or transaction counterparts) strictly for order fulfilment and operational requirements. This information is not used for marketing purposes or disclosed to unrelated third parties.
Users are responsible for keeping their contact details accurate and up to date. Failure to do so may result in failed deliveries, restricted access, or account suspension.
35.2 Date of Birth (DOB) Requirement
CHAAMO requires all users to provide their date of birth during the sign-up process. This is to ensure that all users creating an account are over the age of 18, in accordance with CHAAMO’s platform eligibility requirements.
Accounts cannot be created without submitting a valid date of birth. Any user found to have provided false or misleading age information may have their account suspended or terminated.
CHAAMO reserves the right to request additional documentation to verify a user’s age where necessary.
36. Contact Us
This app is operated by CHAAMO LTD, 287A Fleet Road, Hampshire, GU51 3BZ, England, GB.
Should you become aware of misuse of the app including libelous or defamatory conduct, you must report it to the Company. All reports of misuse and other feedback, comments, requests for technical support, and other communications relating to the app should be directed to support@chaamo.com.
37. Force Majeure
CHAAMO shall not be held liable or responsible for any failure or delay in the performance of its obligations under these Terms of Service due to events or circumstances beyond its reasonable control, including but not limited to:
- Natural disasters (e.g., earthquakes, floods, hurricanes);
- Acts of God;
- Pandemics, epidemics, or other public health emergencies;
- War, terrorism, or civil unrest;
- Government actions or regulations;
- Power outages or telecommunication failures;
- Strikes, labour disputes, or other industrial disturbances.
During such periods, CHAAMO’s obligations shall be suspended, and reasonable efforts will be made to resume operations as soon as conditions permit.
38. Modification or Termination of Services
- Right to Modify
CHAAMO reserves the right to modify, suspend, or discontinue any part of its platform, services, or features at any time, with or without prior notice. This includes changes to functionality, user interface, pricing, and policies. - Termination of Access
CHAAMO may terminate or restrict a user’s access to the platform or services if:- There is a breach of these Terms of Service;
- Continued access poses a risk to the platform, its users, or CHAAMO’s operations.
- No Liability
CHAAMO shall not be held liable for any loss or inconvenience resulting from modifications, suspensions, or terminations of its services. - User Responsibility
It is the user’s responsibility to stay informed of any updates or modifications to the services by reviewing the platform and any related notifications provided by CHAAMO.
38.1 Service Availability
CHAAMO does not guarantee continuous or uninterrupted access to the platform. Periods of maintenance, upgrades, or unforeseen technical issues may temporarily affect availability. CHAAMO will make reasonable efforts to notify users of significant downtime when possible.
38.2 Beta and Early Access Features
Certain features may be released in beta or early-access form. Such features are provided on an “as available” basis and may be modified, limited, or withdrawn at any time without notice. CHAAMO makes no guarantee regarding the performance, availability, or results of beta features.
39. Insurance Policy
39.1 Carrier Liability (Standard Cover)
All shipments processed through CHAAMO’s approved couriers automatically include the carrier’s standard liability cover (“standard insurance”), which provides limited compensation for loss or damage during transit, as defined by each carrier’s own terms and conditions.
This cover is not full-value insurance and compensation is typically limited by weight or a fixed cap — generally between £20 and €750, depending on the courier and service type.
This liability coverage is provided at no additional cost to buyers or sellers and applies only to shipments created through CHAAMO’s integrated shipping partners (via Sendcloud).
A detailed table of carrier liability limits is available below for reference.
39.2 Coverage
Standard liability applies only to shipments booked through CHAAMO’s integrated courier system and covers:
Loss of the parcel during transit, once collected by the courier.
Physical damage to the contents caused during transportation.
39.3 Exclusions
Standard carrier liability does not apply in the following cases:
Items excluded under CHAAMO’s Prohibited and Restricted Items Policy.
Loss or damage occurring after confirmed delivery by the courier.
Incorrect, incomplete, or misleading delivery addresses supplied by the seller or buyer.
Shipments sent outside CHAAMO’s integrated courier network.
Items whose value exceeds the courier’s maximum compensation limit (commonly £100 – €750).
Damage resulting from insufficient or improper packaging by the seller.
Items explicitly excluded by the courier’s terms (e.g., cash, jewellery, fragile glassware, or high-value collectibles).
39.4 Making an Insurance Claim
For Lost Shipments
Verify the tracking number to ensure the parcel has not been delivered.
Contact CHAAMO with the relevant details of the item, transaction, and tracking number.
CHAAMO will open a case with the courier and liaise on behalf of the buyer or seller.
If the courier confirms the parcel as lost, the courier will process a refund in accordance with its liability policy.
The refund will be issued by the courier directly to the affected party (buyer or seller), up to the courier’s standard liability limit.
Claims must be submitted within 7 days of the estimated delivery date.
For Damaged Shipments
The buyer must photograph the damaged item(s) and packaging immediately upon delivery.
The buyer must notify the seller and CHAAMO within 48 hours of receipt.
CHAAMO will contact the courier to initiate the damage claim and submit all required evidence provided by the buyer and seller.
Upon claim approval, the courier will issue compensation up to the applicable limit.
Carrier claim windows and evidentiary requirements may vary by service; where the carrier’s policy differs, the carrier’s terms prevail.
39.5 Optional XCover Insurance
For shipments valued above £100, CHAAMO offers optional extended insurance via its partner XCover, available at checkout for a small additional fee (2 % of the declared item value). XCover is provided by a third-party insurer and is subject to the insurer’s policy terms shown at checkout.
XCover insures the full declared value of the item for loss or damage, up to €5 000 per parcel, including reimbursement of shipping costs where applicable.
Coverage, claims procedures, and time limits are defined by XCover’s policy, displayed at checkout.

39.6 Seller Responsibilities
- Sellers must use adequate protective packaging (e.g., bubble wrap, padded envelopes, top loaders, sleeves) to prevent damage.
- Sellers must ensure that accurate shipping details are provided to avoid delivery issues.
- If a refund is required due to damage only, the seller must process approve the refund as per CHAAMO’s Refund Policy, unless covered by the courier’s insurance.
39.7 Buyer Responsibilities
- Buyers must inspect items immediately upon delivery and report any damage within 48 hours.
- Buyers must provide clear photographic evidence when filing a damage claim.
39.8 Limitation of Liability
CHAAMO is not responsible for:
- Insurance claims that are not covered by the courier’s policy.
- Claims for shipments sent via non-approved couriers.
- Delays in the processing time of insurance claims by the courier.
- CHAAMO acts only as an intermediary between users and courier services.
- CHAAMO is not liable for loss, damage, or delay beyond the carrier’s or insurer’s compensation limits.
All claims are subject to approval by the relevant courier or insurer.
CHAAMO assists in facilitating communication but cannot guarantee or influence claim outcomes.
40. Pricing Accuracy Disclaimer
CHAAMO provides historical pricing data, including “Last Sold Prices,” as a feature to assist users in making informed decisions. These prices are aggregated from multiple third-party sources, and user submissions. While CHAAMO makes every effort to ensure this data is accurate and timely, we do not guarantee the accuracy, completeness, or currency of any pricing information provided.
Pricing data is intended to be used as a guide only. Due to variability in market conditions, incomplete data, or delays in updates from external sources, actual sales prices may differ from those displayed.
CHAAMO is not liable for any decisions, transactions, or losses that result from reliance on the pricing data presented within the platform.
41. Import VAT, Duties & Customs (DDU)
CHAAMO operates as a consumer-to-consumer (C2C) marketplace and does not take ownership of the items sold.
For international shipments, including deliveries into the European Union, CHAAMO is not responsible for any import taxes, customs duties, clearance fees, or handling charges imposed by the destination country.
All international shipments generated through CHAAMO are shipped on a Delivered Duty Unpaid (DDU) basis.
This means:

As CHAAMO is not currently registered under the Import One Stop Shop (IOSS) scheme, import VAT may still apply for EU-bound shipments valued under €150.
If the buyer does not pay the required import fees or refuses delivery, the shipment may be returned or destroyed by customs.
CHAAMO is not liable for losses, delays, or charges that result from unpaid import taxes.
41.1 Buyer Responsibilities
Buyers are responsible for:
Paying any import VAT, duties, brokerage or customs fees due upon arrival
Ensuring compliance with local import rules before completing a purchase
Responding promptly to courier or customs requests for payment
41.2 Seller Responsibilities
Sellers must:
Accurately declare item value and description when generating shipping labels
Use compliant packaging and follow CHAAMO’s Prohibited & Restricted Items Policy
Understand that customs delays do not constitute non-delivery
41.3 CHAAMO’s Role
CHAAMO provides:
Shipping label generation through approved couriers only
Tracking support and basic shipment information
Assistance communicating with carriers for lost or damaged goods claims
CHAAMO does not:
Pay import taxes on behalf of users
Reimburse customs fees, VAT, handling fees, or penalties
CHAAMO provides no tax advice; buyers are responsible for determining and paying any import taxes due
42. Platform Role & Marketplace Disclaimer
CHAAMO operates as a consumer-to-consumer (C2C) platform. We do not own, take title to, or legally offer for sale any items listed by users. Contracts of sale are formed directly between buyer and seller.
Except where expressly stated, CHAAMO is not the seller, merchant of record, importer, exporter, broker, or insurer of any item. CHAAMO does not guarantee item condition, authenticity, grading, or timeliness of delivery and is not responsible for seller performance.
Where CHAAMO provides tools such as shipping label generation, payment rails, pricing data, or buyer protection features, such tools are provided as-is and do not create any obligation beyond those expressly stated in these Terms.
43. Returns & Dispute Resolution (C2C)
Because CHAAMO operates as a consumer-to-consumer marketplace, change-of-mind returns are not supported unless the seller explicitly offers them in the listing.
If an item is materially misdescribed or arrives damaged, the buyer must notify the seller and CHAAMO within forty-eight (48) hours of delivery and provide clear photographic evidence.
Disputes should follow this escalation path:
Buyer and seller attempt direct resolution;
Submission to CHAAMO via the Platform for assistance and evidence review;
If unresolved, CHAAMO may assist with documentation to support a dispute through the third-party payment processor (e.g., PayPal).
CHAAMO’s role in dispute handling is limited to platform enforcement and facilitation. Final decisions regarding payment disputes are made by the relevant payment provider or the buyer’s card issuer.
All disputes must be raised within the timelines set out in Sections 23 and 24 of these Terms. Requests submitted outside those timeframes may be declined.
44. Chargebacks, Holds & Negative Balances
If a buyer initiates a chargeback or dispute through a third-party payment processor (e.g., PayPal), CHAAMO may place a hold on or reserve seller payouts while the matter is under review.
CHAAMO may request supporting evidence from both buyer and seller. Failure to provide relevant documentation promptly may negatively impact dispute resolution and could result in payout restrictions, account limitations, or further enforcement action.
Final decisions regarding chargebacks are made by the relevant payment provider and may be outside CHAAMO’s control. If a dispute or refund results in a negative balance, the seller is responsible for settling any outstanding amounts. CHAAMO does not store or access card details and cannot initiate charges outside the payment provider’s platform.
45. VAT on CHAAMO Service Fees (OSS) & App/Play Store Billing
45.1 OSS on Service Fees
For EU consumers, CHAAMO may apply VAT under the One Stop Shop (OSS) scheme to CHAAMO service fees only (e.g., Platform Fee, Buyer Protection Fee, Shipping, Insurance, Boost/Featured Listing fees). VAT is not charged by CHAAMO on peer-to-peer item sale values.
45.2 Apple App Store & Google Play
Where memberships/subscriptions are purchased via Apple App Store or Google Play, the store operator generally acts as merchant of record and handles VAT according to local rules. In such cases, CHAAMO does not charge VAT directly. For memberships billed outside those stores, CHAAMO will apply VAT where required (including OSS).
45.3 Display
Where applicable, VAT on CHAAMO service fees is applied in accordance with the One Stop Shop (OSS) scheme and is included in the prices displayed at checkout. VAT does not apply to peer-to-peer item sale values.
46. IP Infringement Notice & Takedown (Notice-and-Takedown)
If you believe content or listings infringe your intellectual property, send a notice to support@chaamo.com with:
Your full name, address, and contact email
Identification of the IP right and proof of ownership/authority
The exact URL(s) or listing IDs of the infringing material
A statement of good-faith belief that the use is unauthorised
A statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the owner
Upon valid notice, CHAAMO may remove or disable access to the content, contact the uploader, and, where appropriate, implement repeat-infringer actions.
47. Community & Moderation (Posts, Comments, Profiles)
Users are responsible for all content they post or display on CHAAMO, including usernames, profile information, bios, images, comments, reviews, and other public or private submissions within the platform.
CHAAMO encourages open discussion and community engagement but maintains the right to moderate all user-generated content to ensure safety, legality, and compliance with platform standards.
CHAAMO may edit, hide, restrict visibility of, or permanently remove any content at any time, with or without notice, if such content violates these Terms of Service, applicable law, or community safety guidelines. Moderation decisions are made at CHAAMO’s sole discretion and are final.
47.1 Grounds for Content Removal or Account Suspension
Content or conduct may lead to removal and/or account suspension if it involves or promotes, directly or indirectly, any of the following:
(a) Harassment, bullying, intimidation, or targeted abuse of another user or group.
(b) Hate speech, discrimination, or derogatory content based on race, ethnicity, nationality, gender, religion, sexual orientation, disability, or any other protected characteristic.
(c) Obscene, pornographic, sexually explicit, or excessively violent material.
(d) Threats, incitement of violence, or encouragement of illegal or harmful acts.
(e) False, misleading, or defamatory statements likely to harm another person or business.
(f) Infringement of copyright, trademark, or other intellectual-property rights.
(g) Spam, self-promotion, or repeated posting of irrelevant or commercial content not authorised by CHAAMO.
(h) Off-platform solicitation of sales, trades, or payments intended to circumvent CHAAMO’s systems or fees.
(i) Impersonation of another person, entity, or CHAAMO staff member.
(j) Posting of counterfeit, fraudulent, or otherwise deceptive content.
(k) Disclosure of another user’s personal or private information without consent.
(l) Content containing malware, phishing links, or any attempt to compromise platform security.
(m) Any activity or material that damages, or could reasonably be expected to damage, CHAAMO’s reputation, integrity, or operations.
47.2 Enforcement Actions
Depending on the severity or recurrence of violations, CHAAMO may take one or more of the following actions:
• Removal or editing of the offending content.
• Temporary restriction or suspension of posting privileges.
• Permanent removal of the user’s account.
• Revocation of access to community or marketplace features.
• Referral to law-enforcement authorities where required by law.
CHAAMO reserves the right to act without prior notice in cases involving clear breaches of law, serious threats to user safety, or repeated misconduct.
47.3 Appeals
Users who believe moderation action was taken in error may contact CHAAMO Support at support@chaamo.com within seven (7) days of the decision. Appeals will be reviewed once, and CHAAMO’s determination will be final.

Sellers are solely responsible for determining, collecting, reporting, and remitting any taxes, duties, or charges arising from their sales, including income tax and any VAT/indirect taxes applicable to their activities. CHAAMO does not provide tax advice and is not responsible for a seller’s compliance with tax laws. Sellers must comply with all applicable laws, including consumer protection, product safety, sanctions/export controls, and local marketplace regulations.
49. Off-Platform Transactions & Circumvention

To protect users and reduce fraud, you agree not to solicit, encourage, or complete transactions for items listed on CHAAMO outside the platform. CHAAMO may suspend or terminate accounts for attempts to circumvent fees or safety processes, and may remove listings that indicate off-platform payment, contact details, or links.

CHAAMO processes personal data in accordance with applicable data protection laws. Details, including purposes, legal bases, retention and your rights (access, erasure, objection, portability), are set out in our Privacy Policy (/privacy-policy), which forms part of these Terms. By using the platform, you agree that CHAAMO may conduct identity verification and fraud-prevention checks (including document verification) to protect users and comply with law.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. CHAAMO may assign its rights/obligations in connection with a merger, acquisition, or corporate reorganisation. Nothing in these Terms creates an agency, partnership, joint venture, employment, or franchise relationship between you and CHAAMO.
53. Third-Party Services (PayPal, Sendcloud, Carriers)

Payment services (e.g., PayPal), shipping services (e.g., Sendcloud and underlying carriers), and app stores (Apple/Google) are independent third parties with their own terms. Your use of those services is subject to their terms and fees. CHAAMO is not responsible for their performance, outages, pricing, or policies.

If you are an EU consumer, you may be entitled to use the European Commission’s Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. CHAAMO is not obliged to and does not commit to use ADR/ODR for resolving disputes, but this information is provided as required by EU law.
55. Interpretation & Survival.
Clauses relating to fees, refunds, dispute resolution, carrier liability, intellectual property, limitations of liability, governing law, privacy, and any other provisions which by their nature are intended to survive termination shall remain in full force and effect after the termination of your account or cessation of use of the platform.
